Mutual Aid Agreement

The 2007 Texas Legislature created a Statewide Mutual Aid Agreement for all PUBLIC UTILITIES. This automatic mutual aid agreement is NIMS compliant.

PRIVATE OR INVESTOR OWNED UTILITIES ARE ALSO ENCOURAGED TO BE TXWARN MEMBERS, BUT SHOULD SEE BELOW.

Under this new Automatic Mutual Aid Agreement for governmental entities, it is no longer necessary to sign the TXWARN Mutual Aid agreement for utilities to provide assistance.  

However, TXWARN encourages all to read the Statewide Mutual Aid Agreement in advance to fully understand how the process works. You can review the agreement here.

In the agreement, all mutual aid is provided at the discretion of the providing jurisdiction. You are never obligated to respond to a request to provide mutual aid. Jurisdictions retain the option of providing mutual aid on a case by case basis. The agreement does not supercede any existing agreements already in place. 

This agreement is most valuable when requesting or supplying resources to utilities that don't have existing relationships or agreements. Additionally, this agreement allows for the initiation of mutual aid with a simple request by the authorized authority of the requesting utility. This provision closes the 'response gap' that in the past delayed mutual aid until the issuance of a disaster declaration. Under the new legislation, mutual aid is initiated with the initial request and and corresponding verbal agreement to provide assistance. The request must be formalized within thirty-days, but mutual aid can begin immediately.

PRIVATE OR INVESTOR OWNED UTILITIES

Private or Investor owned utilities are not covered by the Statewide Mutual Aid Agreement and must sign the TXWARN Mutual Aid Agreement (see below) to facilitate rapid emergency response amongst TXWARN member utilities. This agreement is NIMS compliant and this agreement will facilitate the provision and acceptance of aid when a utility accepts aid from or provides aid to a private utility.
